This Confidentiality, Privacy and Data Protection Policy (the “Policy”) sets out how BH Insurance Brokerage LLC represented by its management & all its employees being underwriters, administrators and/or sales representative (hereinafter after referred to as 'BH Insurance') will handle any information (including personal information) that is collected from a customer, or that is provided to BH Insurance otherwise through the course of business.
Collection and Use of Information
BH Insurance considers data and information disclosed by customers and/or business affiliates with whom BH Insurance transacts business with, (the “Confidential Information”) to be private and confidential and BH Insurance is committed to ensuring the protection of all Confidential Information and to fulfilling their responsibilities and obligations under the respective data protection legislation. Accordingly, any Confidential Information disclosed to BH Insurance by a customer or business affiliate with whom BH Insurance transacts business with, (the “Disclosing Party”) will be disclosed on the basis of a confidential relationship between BH Insurance and the Disclosing Party that, unless specifically authorized in writing by the other, BH Insurance will:
a) not disclose any portion of any Confidential Information to any person except those officers, directors, employees, counsel, agents, accountants, financial advisors or representatives (collectively the "Representatives") of BH Insurance who have a need to know basis of such Confidential Information strictly for purposes of the relationship with the Disclosing Party;
b) advise each such Representative before he or she receives direct or indirect access to any Confidential Information of the obligation of BH Insurance and ensure that each such person to whom Confidential Information is disclosed, signs or has signed a written confidentiality agreement which extends BH Insurance obligation to such person;
c) take strict precautions, at a minimum those that BH Insurance affords its’ own confidential information of similar nature, to safeguard and protect from direct or indirect disclosure to any other person; third party, and/or entity, all Confidential Information disclosed by the Disclosing Party to, or otherwise received by, BH Insurance;
In accordance with the above stated obligations, BH Insurance has committed to executing internal agreements between its Representatives and BH Insurance to ensure all such Confidential Information is protected.
BH Insurance uses Confidential Information for the provision and administration of insurance products and related services and reserves the right to disclose, where required, Confidential Information if such disclosures are necessary for the following purposes:
a) for claims handling purposes;
b) for the purpose of preventing, detecting or suppressing insurance fraud;
c) to protect and defend BH Insurance’s rights and property or that of BH Insurance’s clients and business affiliates with whom BH Insurance transacts business with;
d) for any purpose that may be necessary for the performance of any insurance contract entered into between BH Insurance, its business affiliates with whom its transacts business with and a customer;
e) as may be allowed or required by or under any law.
BH Insurance may further, at times, disclose information to agents and/or service providers (appointed by BH Insurance), regulatory bodies, other insurance companies and others who work with BH Insurance in connection with the provision of services to customer and business affiliates.
Security of Data
BH Insurance is committed to protecting the security of the Confidential Information as disclosed by the Disclosing Party.
BH Insurance uses reasonable efforts to safeguard the confidentiality of all Confidential Information that its processes and regularly reviews and enhances its technical, physical and managerial procedures so as to ensure that the Confidential Information is protected from:
1) unauthorized access;
2) improper use or disclosure;
3) unauthorized modification;
4) unlawful destruction or accidental loss.
All BH Insurance employees who have access to, and are associated with the processing of the Confidential Information are obliged to respect the confidentiality of the same, as provided for herein.
It should be noted however that by its very nature the internet is not a secure medium and data sent via this medium can potentially be subject to unauthorized acts by third parties. BH Insurance cannot guarantee the privacy or confidentiality of any information passing over the internet and shall accept no responsibility or liability whatsoever for the security of Confidential Information while in transit through the Internet.
Changes to the Policy
BH Insurance reserves the right to change this Policy from time to time in its sole discretion.
